  •  Please arrive on time: Your face is too important to rush with, so it is our policy not-to proceed with a treatment if there is not enough time for us to ensure perfection. We kindly request that you arrive on-time to avoid any inconvenience of having to reschedule you. Please peruse the below Terms regarding late cancellations and rescheduling.

POLICY:

  • Please arrive in plenty of time for your appointment as we may not be able to accommodate you if you are late
  • You will be required to fill out and sign a client history and consent form, this is confidential information and is required for your own safety and comfort. It is also a requirement for our ongoing professionalism and insurance purposes.
  • Due to the Privacy Act Regulations we are not permitted to disclose or discuss the Vaccination status of any other guests or team members that attend our premises, however, I can assure you that all safety measures in place are above board with Public Health and Safety regulations and we operate in accordance with all regulations.

      1. Schedule of Definitions: 

      Contract means a contract of the sale of Goods arising out of an order accepted by MyRejuvenate;

      Client means the entity  to whom has purchased the Services supplied by MyRejuvenate; 

      Dispute an unresolved claim which arises under these terms and conditions;

      Force Majeure shall include but is not limited to an Act of God, war, natural disaster (including but not limited to an earthquake, hurricane, or volcano event), pandemic, COVID lockdown, terrorism, strike, embargo or unavailability of supply of products or services by the Company for reasons that are outside the Company’s control that has a material and adverse impact on the Company’s ability to supply the Course to the Student. 

      GST means Goods and Services Tax as provided for in A New Tax System (Goods and Services Tax) Act 1999 (Cth);

      Invoice means the Invoices issued by MyRejuvenate in relation to a Contract; and words importing the singular number include the plural and vice versa;

      MyRejuvenate means My Rejuvenate Pty Ltd T/A MyRejuvenate (ACN 617 399 587) and its assigns; 

      Notice means written notice of a dispute in accordance with Clause 12(c);

      Parties means the parties to these terms and conditions;

      Products means purchase products and services that have been listed for sale by MyRejuvenate;

      Purchase Order means an invoice, quotation, purchase order or other document detailing the goods wishing to be purchased;

      Purchase Services means the service provided by MyRejuvenate which allows you to purchase the listed products via the Website or phone service;

      Services means the Services available for purchase through the Website, including but not limited to: 

      1. lash and brow styling; 
      2. cosmetic tattoo brows;
      3. cosmetic tattoo eyeliner; 
      4. cosmetic tattoo lip blush; and 
      5. cosmetic injectables. 

      Services Address means thestudio@myrejuvenate.com.au and Shop 1, 2 Young Street, Annandale NSW 2038. 

      Services Fee means the total monetary amount payable for purchase of products on the website including any associated bank, payment gateway or credit card charges;

      Terms means the terms and conditions contained herein within this document;

      Warranty means a guarantee to repair or replace the products if they fail to be of acceptable quality and the failure does not amount to a major failure;

      Warranty Claim means a claim brought over material defects and workmanship within the warranty period;

      Warranty Period means 30 days from the date of purchase; and

      Website means ‘www.myrejuvenate.com.au’ and any pages or subpages associated with this domain name.

      1. Background
        1. Welcome to MyRejuvenate (the ‘Company‘). The Company provides you with an opportunity to browse, book and purchase the Services that have been listed for sale through the Website. The Website provides this service by way of granting you access to the content on the Website, book and purchase the Services (the ‘Purchase Services’).
        2. The Website is operated by My Rejuvenate Pty Ltd T/A MyRejuvenate (ACN 617 399 587) herein referred to as MyRejuvenate. Access to and use of the Website, or any of its associated Services or Purchase Services, is provided by  MyRejuvenate. Please read these terms and conditions (the ‘Terms‘) carefully. 
        3. MyRejuvenate reserves the right to review and change any of the Terms by updating this page at its sole discretion. When MyRejuvenate updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records
      2. Acceptance of the Terms
        1. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, Services or any of the Purchase Services, immediately.
      3. Availability
        1. MyRejuvenate reserves the right to withdraw any Services from sale temporarily or permanently without prior notice to you for any reason. Some Services might still appear on this Website for a period after that withdrawal but that is not a representation that they are available.
        2. MyRejuvenate reserves the right to accept or reject your Purchase Order for any reason, including, without limitation, an error in the product description or the price posted on the Website, the availability of the Services, or an error in your Purchase Order. Your contract with MyRejuvenate comes into existence when you receive email confirmation from MyRejuvenate containing receipt of your order, an acceptance of your order and confirmation of receipt of your payment.
      1. Arrival time  
        1. You may book a thirty (30) minute which is a consultation only, this is at a cost of $50, which can be redeemed towards a cosmetic tattoo treatment.
        2.  If you arrive 15 or more minutes late your artist will have to cancel the appointment if there is not sufficient time to complete the whole treatment. If your artist can accomodate a different service in that time, they will discuss your treatment options.
      2. Colour Refresh and Touch-up 
        1. Colour Refresh treatment prices are for existing clients only. The colour refresh does not include a complimentary touch-up. 
        2. Your touch-up may not be scheduled for any sooner than 4 weeks since your initial treatment, and is valid for up to 12 weeks only. 
        3. If your touch up is not done at least 12 weeks post initial treatment, you will need to book in an additional adjustment. If the touch up was not done by the 6 month mark, it is then considered a refresh which will be at an increased cost.
        4. Your first touch-up treatment is at a cost of $159, so may not be exchanged for a reduced price if you are unable to attend. Clients who do not attend their scheduled touch-up at 4-12 weeks, or who cancel within 72 hours, forfeit their deposit. 
      3. Deposit and Refund Policy   
        1. A booking deposit of $X (‘Deposit’) is required at the time of booking a Service.
        2. If you attend the consultation and it is not suitable to go ahead with the Service, the Deposit is fully refundable or exchangeable.
        3. Cancellations made less than forty eight (48) hours before your appointment for the Services (‘Late Cancellation’), no shows, or a request for reschedule will result in the forfeit of your Deposit to MyRejuvenate.  
        4. More than one (1) late cancellation will incur the full upfront payment to secure any future bookings. 
        5. A deposit is also required to book in your touch-up and any late cancellation will forfeit your deposit. 
        6. MyRejuvenate will only provide you with a refund of the Purchase Services Fee in the event they are unable to provide the Services or if the manager of  MyRejuvenate makes a decision, at its absolute discretion, that it is reasonable to do so under the circumstances (the ‘Refund‘).
        7. In the event a client has a change of mind in relation to cosmetic tattooing and/or would like it removed, MyRejuvenate will not be liable for any costs or refund of the Purchase Services Fees or Deposit. 
      4. Warranty
        1. MyRejuvenate’s Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of the Product and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure (the ‘Warranty’).
        2. You may make a claim under this clause (the ‘Warranty Claim’) for material defects and workmanship in the Products within 30 days from the date of purchase (the ‘Warranty Period’). All implied warranties are limited to the Warranty Period. 
        3. In order to make a Warranty Claim during the Warranty Period, you must provide proof of purchase to MyRejuvenate showing the date of purchase of the Products, provide a description of the Products and the price paid for the Products by sending written notice to  MyRejuvenate at Shop 1, 2 Young Street, Annandale, NSW, 2038 or by email at thestudio@myrejuvenate.com.au.
        4. Where the Warranty Claim is accepted then MyRejuvenate will, at its sole discretion, either replace or refund any defective Products during the Warranty Period at no charge to you.
        5. The Warranty shall be the sole and exclusive warranty granted by MyRejuvenate, and shall be the sole and exclusive remedy available to you in addition to other rights and under a law in relation to the Products to which this warranty relates.
      5. Copyright and Intellectual Property
        1. The Website, the Purchase Services and all of the related products of  MyRejuvenate are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website, code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by  MyRejuvenate or its contributors.
        2. MyRejuvenate retains all rights, title and interest in and to the Website and all related Purchase Services. Nothing you do on or in relation to the Website will transfer any:
          1. business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or
          2. a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or
          3. a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process), to you.
      1. Payment
        1. Prices for the Purchase Services and Services will be as per the MyRejuvenate prices as listed on the Website. 
        2. You agree to any fees payable for any Product Services and Services listed on the Website which may be amended from time to time at the Company’s discretion.
        3. If and when applicable, GST payable on our Services will be set out on our invoices. By accepting these Terms, you agree to pay MyRejuvenate an amount equivalent to the GST imposed on these charges. GST means GST as defined in the A New Tax System (services and Services Tax) Act 1999 (Cth) as amended from time to time or any replacement or other relevant legislation and regulations. 
        4. All amounts are in Australian dollars and include GST. MyRejuvenate is not responsible for exchange rate fluctuations or changes in GST rates and reserves the right to increase the gross price should GST and/or any other rates increase. 
        5. All payments made in the course of your use of the Purchase Services are made using a third party provider. In using the Website, the Purchase Services or when making any payment in relation to your use of the Purchase Services, you warrant that you have read, understood and agree to be bound by the terms and conditions of the third party provider, which are available on their website.
        6. You acknowledge and agree that where a request for the payment of the Purchase Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Purchase Services Fee.
        7. You understand that the pricing structure, payment methods, payment processes and these Terms may be amended at any given time at the sole discretion of MyRejuvenate. 
      2. Privacy
        1. MyRejuvenate takes your privacy seriously and any information provided through your use of the Website and/or the Purchase Services are subject to  MyRejuvenate’s Privacy Policy, which is available on the Website.
        2. You consent to MyRejuvenate taking “before and after” photos of the cosmetic tattoo area for the purposes of posting on social media to demonstrate the work. For your privacy MyRejuvenate will not post a photo of your full face (unless specifically requested). If you do not wish for the photos to be used on social media, please inform MyRejuvenate. 
      3. General Disclaimer
        1. Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
        2. Subject to this clause, and to the extent permitted by law:
          1. all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and
          2. MyRejuvenate will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.
        1. MyRejuvenate makes no guarantees on how your body will heal or retain the tattooed pigment, this is out of the control of the artist and varies based on each individual. Even when following the aftercare correctly there is a chance that pigment may not hold in the skin or last as long as expected. This is not the fault of the artist. Skin altering procedures including but not limited to plastic surgery, cosmeceutical treatments, and/or injections may alter and degrade the skin and affect how the cosmetic tattoo holds in the skin. Additionally, medical conditions and/or certain medications may prevent the pigment from retaining or cause it to fade quickly or change in colour. 
        2. In the event that the Service does not achieve a successful outcome, MyRejuvenate will offer one (1) free treatment, and additional (at their discretion). MyRejuvenate reserves the right to use their discretion in deciding if a Service has been successful or not, and the number of free treatments they provide as a result. 
        3. If the cosmetic tattooing enhancement Services provided fades after three (3) months but within six (6) months, MyRejuvenate offers a heavily discounted re-treatment to Clients, this offer is subject to the discretion of MyRejuvenate. 
        4. If you have received cosmetic tattooing prior to purchasing the Services offered by MyRejuvenate, there are no guarantees to the retention of pigment. There may be underlying scar tissue or pigment congestion from previous work which will affect the healed outcome of MyRejuvenate’s work. 
        5. Use of the Website and the Purchase Services is at your own risk. Everything on the Website and the Purchase Services is provided to you “as is” and “as available” without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors and licensors of MyRejuvenate make any express or implied representation or warranty about the Purchase Services or any products or Purchase Services (including the products or Services of MyRejuvenate) referred to on the Website, includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:
          1. failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;
          2. the accuracy, suitability or currency of any information on the Website, the Products, or any of its Purchase Services related products (including third party material and advertisements on the Website);
          3. costs incurred as a result of you using the Website, the Purchase Services or any of the products of  MyRejuvenate; and
          4. the Purchase Services or operation in respect to links which are provided for your convenience.
      1. Liability
        1. MyRejuvenate is not liable for any loss caused by a Force Majeure Event and shall be excused from performance of their respective obligations when and to the extent such performance is delayed or prevented by a Force Majeure Event. If your need for the Purchase Services is reduced or suspended as a result of the Force Majeure Event, and notification is within reasonable time of acceptance of the Purchase Services and prior to the delivery of the Services, you shall be entitled to terminate the Agreement. 
        2. MyRejuvenate’s total liability arising out of or in connection with the Purchase Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.
        3. You expressly understand and agree that  MyRejuvenate, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.
        4. Subject to the applicable laws, MyRejuvenate is not responsible or liable in any manner for any site content (including the Content and Third Party Content) posted on the Website or in connection with the Purchase Services, whether posted or caused by users of the website of  MyRejuvenate, by third parties or by any of the Purchase Services offered by  MyRejuvenate.
      2. Termination of Contract
        1. The Terms will continue to apply until terminated by either you or by MyRejuvenate as set out below.
        2. MyRejuvenate may at any time, terminate the Terms with you if:
          1. you have breached any provision of the Terms or intend to breach any provision;
          2. MyRejuvenate is required to do so by law;
          3. the partner with whom MyRejuvenate offered the Purchase Services to you has terminated its relationship with MyRejuvenate or ceased to offer the Purchase Services to you; or 
          4. the provision of the Purchase Services to you by  MyRejuvenate is, in the opinion of  MyRejuvenate, no longer commercially viable.
        1. When the Terms come to an end, all of the legal rights, obligations and liabilities that you and MyRejuvenate have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of this clause shall continue to apply to such rights, obligations and liabilities indefinitely.
      1. Indemnity
        1. You agree to indemnify MyRejuvenate, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:
          1. all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with the provision of Services;
          2. any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or
          3. any breach of the Terms.
      1. Dispute Resolution and Defamation 
        1. You agree not to post any content on any website(s) or social media accounts that is or could reasonably be considered inappropriate, defamatory, disparaging or would otherwise bring MyRejuvenate into disrepute.
        2. Compulsory:
          If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).
        3. Notice:
          A party to the Terms claiming a dispute (‘Dispute‘) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.
        4. Resolution:
          On receipt of that notice (‘Notice‘) by that other party, the parties to the Terms (‘Parties‘) must:
          1. Within 14 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;
          2. If for any reason whatsoever, 14 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the President of the Australian Mediation Association or his or her nominee;
          3. The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a precondition to the mediation commencing. The Parties must each pay their own costs associated with the mediation;
          4. The mediation will be held in Sydney, Australia.
        1. Confidential:
          All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.
        2. Termination of Mediation:
          If 2 weeks have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.
      1. Venue and Jurisdiction
        The Products and Purchase Services offered by  MyRejuvenate are intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of  New South Wales, Australia.
      2. Governing Law
        The Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of  New South Wales, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.
      3. Severance
        If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.

        Privacy Policy

        • Your privacy is important to us. It is My Rejuvenate’s policy to respect your privacy regarding any information we may collect from you across our website, https://myrejuvenate.com.au, and other sites we own and operate.
        • We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.
        • We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification.
        • We don’t share any personally identifying information publicly or with third-parties, except when required to by law.
        • Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.
        • You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.
        • Your continued use of our website will be regarded as acceptance of our practices around privacy and personal information. If you have any questions about how we handle user data and personal information, feel free to contact us.
